Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your,” “Customer,” or “Organization”) and Surveyi (“Surveyi,” “we,” “us,” or “our”). By accessing or using Surveyi (including creating an account, sending surveys, or viewing analytics), you agree to these Terms. If you do not agree, do not use Surveyi.
1. Key definitions
“Service” means the Surveyi website, applications, APIs, survey delivery tools, and related analytics. “Respondent” means an individual who receives or responds to a survey created by a Customer. “Customer Data” means survey configuration and response content submitted to the Service. “Output” means analytics, summaries, scores, themes, alerts, and other derived results generated by the Service.
2. Eligibility
You must be at least 18 years old and have authority to enter into these Terms on behalf of yourself or the business you represent. You are responsible for ensuring your use of Surveyi complies with applicable laws (including privacy and marketing laws) in your jurisdiction.
3. The Service
Surveyi is a feedback and insight platform that helps Customers create and deliver surveys, collect responses, and view analytics and AI-based insights. The Service may also generate Output (such as summaries, themes, sentiment scoring, and alerts).
We may modify, update, suspend, or discontinue any part of the Service at any time for performance, security, compliance, or operational reasons. We do not guarantee any specific features will remain available indefinitely.
4. Your account
- You must keep your credentials secure.
- You must provide accurate account information.
- You are responsible for all activity under your account, including surveys you send and how you use results.
If you suspect unauthorized access, contact us immediately.
5. Customer responsibilities (Respondents + compliance)
You are responsible for your surveys and Customer Data, including:
- Providing all required notices to Respondents and obtaining any required consents (e.g., for marketing, tracking, or collecting certain information).
- Complying with applicable laws and rules (privacy, anti-spam, consumer protection, employment, communications regulations, etc.).
- Ensuring you have rights to collect and submit Customer Data, and that your collection does not violate third-party rights.
If Respondents submit sensitive personal information, you are solely responsible for any legal requirements related to that data.
6. Acceptable use
You agree not to (and not to allow others to):
- Break any law or violate the rights of others (including privacy or IP rights).
- Collect sensitive personal data without appropriate legal basis, notices, and consents (e.g., health data, payment card numbers, government IDs).
- Harass, threaten, target, discriminate, or facilitate abusive content.
- Probe, scan, test, or attempt to bypass security; interfere with the Service; or overload infrastructure.
- Reverse engineer, copy, resell, scrape, or create a competing service using the Service, Output, or UI.
- Use automated means to access the Service except via published APIs or with our written permission.
We may suspend or terminate accounts that violate these rules.
7. Intellectual property and license
a. Your content
You retain ownership of Customer Data. You grant Surveyi a non-exclusive, worldwide license to host, transmit, process, and display Customer Data solely to provide, secure, and improve the Service and to generate Output requested by you.
b. Surveyi platform
Surveyi owns the Service, including the software, models, workflows, interfaces, brand, and underlying systems. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes.
c. Feedback
If you provide suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction.
8. Output, analytics, and AI features
Output is generated automatically and may be inaccurate, incomplete, or unsuitable for certain uses. You are responsible for reviewing Output before acting on it. Surveyi does not provide legal, medical, financial, or professional advice.
9. Billing & subscriptions
Some features require payment. Billing is handled by third-party processors (e.g., Stripe). By purchasing a plan, you authorize charges for fees, taxes, and other amounts disclosed at checkout.
Subscriptions typically renew automatically unless you cancel. If you cancel, access continues through the end of the billing period. We may suspend or downgrade service if payment fails or usage exceeds plan limits.
10. Third-party services
The Service may integrate with third-party services. We are not responsible for third-party services, their availability, or their policies. Your use of third-party services is governed by their own terms.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURVEYI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, SURVEYI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST GOODWILL, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID TO SURVEYI IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to defend, indemnify, and hold harmless Surveyi and its owners, employees, and contractors from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) Customer Data and your surveys, (c) your violation of law or third-party rights, or (d) your misuse of Output or communications with Respondents.
14. Termination
You may stop using Surveyi at any time and may request account closure. We may suspend or terminate access if you violate these Terms or create security/legal risk.
After termination, we may retain limited information as required by law or for legitimate business purposes (fraud prevention, audits, dispute resolution, and security). See our Privacy Policy for more.
15. Dispute resolution (optional)
You and Surveyi agree to try to resolve disputes informally first by contacting us. If we can’t resolve it, disputes may be resolved in the courts located in the state where Surveyi is organized and operates, unless applicable law requires otherwise. (If you want arbitration + class action waiver, tell me and I’ll drop in a clean clause.)
16. Governing law
These Terms are governed by the laws of the United States and the state where Surveyi is organized and operates, without regard to conflict of law principles.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material, we’ll update the “Last updated” date and may provide additional notice. Continued use of Surveyi after changes means you accept the updated Terms.
